Estate Planning Process

The first step will be to determine whether or not you require a simple Will or both a Will and a Trust. In order to determine which estate plan is the most appropriate for your current situation, we will meet with you to complete a simple profile questionnaire either telephonically or in person.

Once we determine what type of estate plan is needed for your unique situation, we will prepare a first draft of the documents for you to review and discuss with your family members. We will then discuss with you any changes you may wish to make, for example in the distribution of your estate, and final documents will then be prepared for your signature. If a trust is established, then certain assets will need to be transferred to the trust.

Litigation -- Will and or Trust Contests

Mayo & Mayo also represents and protects the interests of beneficiaries in the event that the provisions of the Will or Trust are disputed. Mayo & Mayo is proficient in handling either litigation or alternative dispute resolutions related to all aspects of contested estates, including,
  • Beneficiary disputes
  • Creditor claims
  • Trustee or Executor issues (such as breach of fiduciary duties)
  • Guardianship and Conservatorship issues
